Application Forms - Mortgage Loan Originators

On or after July 1, 2010, unless exempt from licensing, no individual can act as a mortgage loan originator (MLO), or hold himself out to the general public as a mortgage loan originator, unless such individual has first obtained a license under Chapter 16.1 of Title 6.1 of the Code of Virginia.

Chapter 16.1 requires the filing of an application for a mortgage loan originator (MLO) license through the Nationwide Mortgage Licensing System (NMLS). The NMLS began accepting applications for a Virginia MLO license on August 3, 2009. You are urged to file an application as soon as practicable and preferably by the end of 2009, in order to obtain the required license by July 1, 2010. We strongly recommend that you review the information available from our site, including the FAQs, before continuing with the application process.

The MLO application form is referred to as Form MU4. Each individual mortgage loan originator must submit Form MU4 through NMLS. If an individual has submitted Form MU4 in another state, re-entry of the record into NMLS is not required; rather, the Virginia Mortgage Loan Originator license request should be added in the license wizard in NMLS for submission. The MU4 application and Virginia Jurisdiction Specific forms can be accessed on the NMLS website through the link below. Virginia Jurisdiction Specific forms must be downloaded and submitted to the Bureau at the time the MU4 is electronically filed.

Links to related laws and regulations appear below. Code and Regulation Sections can be viewed and downloaded individually or a report of multiple Sections can be created and downloaded. To download multiple Sections click on “create report” at the beginning of the table of contents for the specific Chapter and enter the beginning and ending Section of the sequence you wish to download. It is your responsibility to read and comply with all applicable laws and regulations.

    Reminder: Virginia jurisdiction-specific forms, available from the NMLS site, must be downloaded and submitted to the Bureau at the time the MU4 is electronically filed.

Note: All applications are investigated by the Bureau of Financial Institutions. Certain application decisions are made by the Commissioner of Financial Institutions under delegated authority from the State Corporation Commission. In the event you wish to appeal either a determination made by the Bureau of Financial Institutions in the course of its investigation of your application or the Commissioner of Financial Institutions’ decision on your application, you may request a formal review by the State Corporation Commission in accordance with its Rules of Practice and Procedure
